About these terms

JobPick is a job board for the Australian hospitality industry. These terms are the agreement between you and us, covering the website, your account and everything you do through it.

By creating an account, posting a job, or applying for one, you accept them. If you are using JobPick for a business, you are agreeing on that business's behalf and confirming you are authorised to do so.

How we handle personal information is set out separately in our Privacy Policy, which forms part of this agreement. JobPick is a place where candidates and employers find each other: we are not your employer, we are not an employment agency, and we are not a party to anything you agree with someone you meet here.

Your account

You need an account to apply for a job or to hire through JobPick. You must be at least 16, give us accurate details, and keep them up to date.

Your account is yours alone. Keep your password to yourself, and tell us promptly if you think somebody else has got into it. Until you do, you are responsible for what happens under it.

We may ask you to verify your email address or mobile number before parts of the product open up, and we ask an employer to verify the business behind the account before their postings carry a verified badge.

If you are looking for work

Your profile is what employers read, so it has to be true. Describe your own experience, qualifications and work rights accurately, and only upload documents you are entitled to share.

Applying does not oblige an employer to reply, to interview you, or to explain a decision. An employer keeps a copy of your application as it stood when you sent it; withdrawing it tells them you are no longer interested, but it does not unsend it.

Looking for work on JobPick is free. We will never ask you to pay to apply for a job, and no employer should either — if one does, tell us.

If you are hiring

A posting must be a genuine, currently open role at the business named on it, and must describe the job, the pay and the conditions honestly.

You are responsible for hiring lawfully. That includes Australian anti-discrimination law, the Fair Work Act 2009 (Cth), and any award or agreement that covers the role. Do not post a role, a requirement or a screening question that discriminates on a protected attribute.

Candidate information reaches you for one purpose: assessing that person for the role they applied to. You must not use it for anything else, sell it or otherwise pass it on, or keep it once you no longer need it. Everyone you invite onto your team takes on the same obligations, and you remain responsible for what they do with their seat.

We may decline, edit or take down a posting that breaks these rules, and we may suspend an account that repeatedly does.

What you upload

Your CV, your profile, your job ads and your messages stay yours. You give us permission to store them and to show them to the people the product is meant to show them to — an employer you apply to, a candidate reading your posting, a colleague on your team.

That permission is only as wide as running the service needs, and it ends when you delete the content or close your account, except where we have to keep a copy. The Privacy Policy says what we keep and why.

The site itself — the software, the design, the JobPick name and marks — belongs to us, and using the product does not transfer any of it to you.

What you may not do

While using JobPick, do not:

  • post anything false, misleading, defamatory, obscene, hateful or unlawful
  • impersonate another person or business, or claim a qualification, licence or work right you do not hold
  • post a job that does not exist, or a listing that is really an advertisement, a course or a recruitment pitch
  • scrape, bulk-download or harvest profiles, postings or contact details, by any means
  • use the product to send spam, chain messages or unsolicited commercial offers
  • work around a security control, a rate limit or an access restriction, or probe the service for weaknesses without our written permission
  • upload malware, or anything else designed to interfere with the service or with other people's use of it

Matching and automated processing

We read uploaded CVs automatically to propose profile details, we score how a profile lines up with a posting, and we show that score to both sides. It is a reading aid, not a decision.

Nothing a parser proposes joins your profile until you accept it, and you can correct anything it got wrong. A match band is an estimate and can be wrong. No application is rejected by us automatically — every hiring decision is the employer's, and JobPick has no part in it.

Fees

Candidate accounts are free. Where an employer product is paid, its price and billing terms are shown before you buy, and those terms sit alongside this agreement.

Fees are in Australian dollars and include GST unless we say otherwise.

Availability and changes

We work to keep JobPick running, but we do not promise it will be uninterrupted or error-free, and parts of it will be down for maintenance from time to time.

The product changes as we build it, and we may add, alter or withdraw features. Where a change materially reduces something you are paying for, we will tell you before it takes effect.

Closing an account

You can close your account at any time from your account settings.

We may suspend or close an account that breaks these terms, that puts other people using JobPick at risk, or that we are required to act on by law. Where it is reasonable to do so, we will tell you why and give you a chance to put it right.

Closing an account does not withdraw applications you have already sent or postings you have already published, and the parts of these terms meant to outlast the agreement keep applying.

Liability

Nothing here excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, we limit it to resupplying the service or paying the cost of having it resupplied.

We do not verify every claim made by an employer or a candidate. We are not responsible for a hiring decision, for what happens in a job you get through JobPick, or for anything you agree with somebody you met here — and, to the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits, opportunities or data.

If you use JobPick for a business, you agree to cover us for claims brought against us because of how you used it, including a posting you published or information you took from a candidate.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that state.

If something goes wrong, tell us first. Most problems are quicker to fix by writing to us than by anything more formal.

Changes to these terms

We update these terms as the product changes. The date at the top is when the text last changed, and the current version always lives at this address.

For a change that materially affects your rights we will give you reasonable notice — by email, or in the product — before it takes effect. Carrying on using JobPick after that is how you accept it.
